You may be able to complain to an Employment Tribunal (Industrial Tribunal in Northern Ireland) if you feel you were unfair dismissed, either because of the reason for your dismissal or the process used.

Unfair dismissal could be:

  • There was nothing wrong with your job performance and therefore your employer does not have a fair reason for dismissing you
  • Your employer did not follow the company dismissal procedure
  • You were dismissed for an automatically unfair reason, for example because you wanted to take maternity leave
  • Other reasons for automatic unfair dismissal include dismissal because of gender, age or for exercising your statutory employment rights.  If you are dismissed for any of these reasons, you should be able to make a claim for unfair dismissal to an Employment Tribunal.
  • Redundancy and retirement are forms of dismissal and if the reason for this is unfair, you will have been unfairly dismissed.
Other examples of unfair dismissal may relate to the following instances:

  • Dismissal relating to part-time or fixed-term work
  • Dismissal in connection with disciplinary or grievance hearings
  • Dismissal relating to your working time
  • Dismissal relating to part-time or fixed-term work
  • Dismissal relating to trade union reasons
  • Dismissal during an industrial dispute
  • Dismissal relating to the National Minimum Wage (NMW)
  • Dismissal relating to activities as an occupational pension scheme trustee
  • Dismissal for taking action on health and safety grounds
  • Dismissal relating to activities as an employee representative
  • Dismissal relating to tax credits
