The concept of a bailiff can be intimidating, however, despite preconceptions, the majority of certificated bailiffs act as debt recovery officers on behalf of a creditor or the courts.

Bailiffs possess some legal powers as debt collectors, by way of legal authority to carry out debt recovery on behalf of the creditor, but also by means of a warrant for actual debt collection. This is sometimes called a warrant of execution.

Are bailiffs allowed into my home?

If a bailiff comes to your house, he or she is obliged to display suitable identification upon request.

Although there are different types of bailiffs, most will also be in possession of a letter of warrant or a certificate endowing them with the authority to recover debt.

Most bailiffs, working for bailiff services do not have the right to force their way into your home and can only enter peacefully by way of invitation.

However, a bailiff collecting unpaid taxes on behalf of the Inland Revenue can gain a warrant to force entry to your home.
